Warrant fills in details of alleged rape by fired AL State Trooper
MONTGOMERY, AL (WSFA) -
New details are surfacing in the case against a former Alabama State Trooper who was fired after being arrested on rape and sodomy charges.
According to arrest warrants, the rape victim told investigators that on December 6, 2015 a state trooper responded to reports of an accident in which the victim was involved. That trooper was identified as Samuel H. McHenry II, 36, of Rutledge.
The warrant states that Trooper McHenry worked the scene of the accident and during that time found pill bottles in the victim's car. He's then alleged to have threatened with arrest. The trooper then allegedly put the victim, uncuffed, into the back of his patrol vehicle before driving her to Butler County exit 107.
After stopping the car, the warrant alleges Trooper McHenry got out and told the woman that she could either "F*** him or go to jail". The victim stated in the arrest report that Trooper McHenry then forced himself on her and raped her.
Afterward, the victim stated Trooper McHenry forced her to perform oral sex on him before driving her to exit 101 where she was put out of the patrol car at a closed store.
Following the victim's report, the Butler County Sheriff's Office notified the State Bureau of Investigation which opened a criminal investigation.
McHenry was then arrested and taken to the Butler County Jail where he was booked on one count of each charge. He was then fired from his position with the Alabama State Troopers.
McHenry was given an initial court appearance where he was advised of his rights and informed of the charges against him. Bond was set at $150,000 with a release condition that he stay away from the victim.
McHenry, who did not demand a preliminary hearing, was released on bond Wednesday afternoon.
